A. Public Comment
Resident Mary Schmaltz approached the Town Board to disperse pamphlets and flyers
that have been created by the Village of Wappingers Falls Recreation Department. She stated
that they do not cost the taxpayers anything. She then handed out invitations and schedules for
upcoming Memorial Day Ceremonies. She also handed out a history of the streets written by Bill
Parsons. Ms. Schmalz asked why the Town Board was not going to apply bug spray at Reese
Park and stated that they should because a lot of people walk their dogs in that park. Ms.
Schmalz explained to the Board that most people coming to Town Hall do not know that the
property is now smoke free. People approach the building while smoking cigarettes and do not
see the sign until they reach the front door. Ms. Schmaltz suggested a sign be put up at the
entrance to the property stating that it is a smoke free property.

A. Award Tick Spray bids
Motion To: Accept Red Cedar
Supervisor Gutzler directed the Board to a memo sent by Mark Price describing bid
results for spraying tick spray on Town owned properties. Mr. Price's memo stated that the
winning bid for the spray was Red Cedar Arborist. Supervisor Gutzler asked the Board for a
motion to award the bid to Red Cedar Arborist per the recommendation of the Recreation
Department. Councilman Bettina Moved the motion, Councilman Kuzmicz seconded it, and all
were in favor.

Supervisor Gutzler stated that the date of the second monthly Town Board meeting in
May falls on the Memorial Day Holiday. She suggested moving it to the following day, Tuesday,
May 28`x'. Councilman Kuzmicz made a motion to move the meeting to Tuesday May 28, 2013,
Councilwoman Czarniecki seconded the motion, and all were in favor.

Councilman Kuzmicz stated that he brought up the topic of Martz Field because it had
been discussed before, he would like an update on the cracks in the tennis court at Martz Field,
and he would like to come to a finalization on the repairs. He stated that he had discussed the

repairs with Engineer to the Town, Robert Gray, and Mr. Gray had submitted a couple proposals
on what can be done to repair the tennis court. Mr. Gray stated that he had met with Highway
Superintendent, Graham Foster, at the site and measured the cracks. There is about 500 feet of
cracks. The plan would be to cut out the area with the cracks, lay new blacktop, and then color
the area to match the existing blacktop on the court. The cost estimate was $30 per foot or about
$15,000 to repair all of the cracks. In addition, Mr. Gray stated that on one of the other courts,
some of the posts have rotted away and fallen off. Others are showing signs of heaving because
they were not installed below the frost line. He received an estimate to replace at least the
missing post. It will cost $3,500 dollars to replace the missing posts. Mr. Gray pointed out that
the other posts are serviceable as they are. He then described that the other option would be to
replace the entire court and possibly the fence. He stated that in the past it cost, to repace four
courts had been about $240,000 which included the fence. He estimated that since currently only
two courts would be being replaced it would be approximately half the cost of what it had been
to replace the four courts. Supervisor Gutzler stated that she wasn't sure if the fence needed
replacing. Councilman Kuzmicz said that he had never noticed if there were any issues with the
fence, he had been more concerned with the cracks in the blacktop.
Supervisor Gutzler pointed out that if the Board was going to consider total replacement
of the courts, it should be sure that a lot of people use. Also, they should consider ways to
prevent damage and vandalism. She explained that there have been people doing things like
skateboarding on the tennis courts. She suggested the possibility of installing a self locking gate
that could have a card reader. The Town would issue permits to residents allowing them access
to the tennis courts. The permits would be issued to the residents at no cost. Supervisor Gutzler
also proposed that the tennis courts could be rented out to schools, tennis leagues, or permits
could be sold to non-residents. She stated that she would like to look into these possibilities.
Supervisor Gutzler asked if the Board could consider the information and possibly make a
decision at the next Town Board meeting. Councilman Kuzmicz stated that two weeks is a
reasonable amount of time for consideration. He then pointed out that he would like to have the
repairs completed by the end of the summer. Supervisor Gutzler asked how long it would take to
complete the repairs. Engineer to the Town, Robert Gray explained that it would take about a
month, however it may be difficult to find a blacktop company that isn't busy at this time. He
also said that there is the matter of finding money in the budget. Supervisor Gutzler said that
there should be a meeting with the recreation department and recreation committee to see how
practical the project would be.

D. Resident Request to Speak
Supervisor Gutzler requested a suspension of the rules. Councilman Bettina motioned for
a suspension of the rules. Councilman Kuzmicz seconded the motion and all Board members
present voted in favor of the motion.
Tina Settembrino a Town of Wappinger resident, explained that for the past five years
she has been dating Mr. Kenny Michelin. Mr. Michelin is also a Town of Wappinger resident.
She stated that Mr. Michelin often takes her car to work and she often drives his. Last year, she
purchased a Town of Wappinger recycling center permit because she had many items to dispose.
This year, Mr. Michelin offered to purchase the permit for her vehicle, because he has items to
dispose of and she does not. Ms. Settembrino stated that she told Mr. Michelin that because he
was over 60 years old he could obtain the permit for thirty dollars, whereas she would have to
pay fifty dollars. She then explained that when she went to the Town Clerk's office to purchase a
permit, she found out that her vehicle could not be permitted under Mr. Michelin's name because
it was not registered to his property. She stated that she explained to the Town Clerk that the two
of them live together and share everything, but her car is registered at her home not his. She
didn't want to pay the cost of re -registering her car at his address. However, she would change
the address when the registration expired. She then asked the Board if Mr. Michelin could
purchase the recycle center permit for her vehicle under his name. Supervisor Gutzler said that
she had talked to the Board and explained to Ms. Settembrino that the purchasing of recycle
center permits runs by household. If Ms. Settembrino and Mr. Michelin had the same address, it
wouldn't be a problem. Councilman Bettina, asked Attorney to the Town, Al Roberts, for his
advice. Councilman Bettina asked Mr. Roberts if he felt that allowing Ms. Settembrino to have a

recycling center permit under Mr. Michelin's name would set a precedent that would open up the
flood gates for other residents. Mr. Roberts stated that once you grant an exception, you have to
grant that exception to all people who are in a similar situation. He also said that the Board could
set up a system for granting exceptions and delegate the right to grant exceptions to the Town
Supervisor or Highway Superintendent. Councilman Bettina stated that he was not willing to
abdicate the right to make these decisions to anyone. He also asked Mr. Roberts to research the
issue further. Councilman Kuzmicz stated that he thought the Board needs to be careful of
having ambiguous rules that are not clearly defined. If one person is issued a permit without
providing proof that they are living in a particular household, nothing can stop the next person
from obtaining a permit without providing proof. Without clear rules, the system is open to
abuse. Councilwoman Czamiecki asked Ms. Settembrino to clarify if it was correct that: Mr.
Michelin would like to buy the permit, that they would like to purchase the permit for a vehicle
registered to Ms. Settembrino, and that the fee for that permit would be $50. Ms Settembrino
stated that she does not want to register the vehicle under Mr. Michelin's name because it would
be too expensive. Councilwoman Czamiecki said that then the cost for the permit would be $50.
She also stated that the Board should wait for the opinion of the Attorney to the Town before
giving her an answer. Supervisor Gutzler stated that the policies for the recycling center needed
to be examined. She also explained that there had been a meeting on the recycle center policies
recently where some changes had been made. Ms. Settembrino said that she felt it was ridiculous
to have to come in front of the Board with her issue. Supervisor Gutzler stated that she told Ms.
Settembrino she could come to the Board meeting and ask for a ruling when she would not
accept the answer she had given. Councilman Bettina stated that no employee or Board member
can make a decision alone. Supervisor Gutzler stated that if an exception is made for one person,
that exception will have to be given to everyone. She told Ms. Settembrino that even if there was
not an immediate benefit to her bringing her problem to the board, it could create some benefit in
the future. Supervisor Gutzler told Ms. Settembrino that if there was a way that she could benefit
from a change made in recycle center policy she would contact her.
Councilman Bettina made a motion to come back into session. Councilwoman Czamiecki
seconded the motion. Allwere in favor.

RESOLUTION: 2013-133
Order Calling Public Hearing in the Matter of the Increase and Improvement of the
Facilities of the United Wappinger Sewer District in the Town of Wappinger, Dutchess
County, New York (Additional Costs)
WHEREAS, pursuant to proceedings heretofore had and taken by the Town Board of the
Town of Wappinger, Dutchess County, New York, pursuant to the provisions of Section 202-b
of the Town Law, it has been determined to be in the public interest to provide for a certain
increase and improvement of the facilities of United Wappinger Sewer District, at a maximum
estimated cost of $385,000; and
WHEREAS, such increase and improvement of the facilities of United Wappinger Sewer
District, in the Town of Wappinger, Dutchess County, New York, consists of the District's share
of the cost of improvements to the Wappingers Creek Pump Station located at the corner of
Market Street and Franklindale Avenue in the Village of Wappingers Falls, a facility of Tri -
Municipal Sewer Commission, including original furnishings, equipment, machinery, apparatus,
appurtenances and incidental improvements and expenses in connection therewith, as further
described in a map, plan and report by a competent engineer, which is on file in the office of the
Town Clerk of such Town where it may be inspected during normal business hours; and
WHEREAS, in order to complete the improvements to the aforesaid facilities, it will be
necessary to expend the sum of $580,000, an increase of $195,000 over that previously
authorized; and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to
the regulations of the New York State Department of Environmental Conservation promulgated

pursuant to the State Environmental Quality Review Act, the implementation of which as
proposed, the Town Board has determined will not result in any significant environmental
effects; and
WHEREAS, it is now desired to call a public hearing on the question of authorizing such
increase and improvement of facilities at a revised maximum estimated cost of $580,000;
NOW, THEREFORE, IT IS HEREBYORDERED, by the Town Board of the Town of
Wappinger, Dutchess County, New York, as follows:
Section 1. A public hearing will be held at the Town Hall, in Wappingers Falls, New York,
in said Town, on the 10th day of June 2013, at 7:30 o'clock P.M., Prevailing Time, on the
question of increasing and improving the facilities of United Wappinger Sewer District in the
manner described in the preambles hereof, and to hear all persons interested in the subject
thereof, concerning the same, and to take such action thereon as is required or authorized by law.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice
of Public Hearing hereinafter provided to be published once in the official newspaper designated
for this purpose, and also to cause a copy thereof to be posted on the sign board of the Town,
such publication and posting to be made not less than ten, nor more than twenty, days before the
date designated for the hearing.
Section 3. The notice of public hearing shall be in substantially the form attached hereto as
Exhibit A and hereby made a part hereof.
Section 4. This Order shall take effect immediately.

RESOLUTION: 2013-134
Resolution Authorizing Commencement of Litigation Against Owners of 1 Pattie Place for
Continuing Violations of NYS Property Maintenance Code
WHEREAS, the property located at 1 Pattie Place in the Town of Wappinger, County of
Dutchess, State of New York, and further identified by tax map parcel 6158-04-934063
(hereinafter "the Property") is presently used as a residential property containing one single
family resident; and
WHEREAS, the owners of the Property, Gerald M. Reiser and Nola Dee Reiser, have
accumulated, caused, or permitted to exist, debris, rubbish, junk, unregistered vehicles on the
Property and otherwise failed to maintain the Property in a safe and sanitary manner; and
WHEREAS, the owners of the property, Gerald M. Reiser and Nola Dee Reiser, have
failed to maintain the Property in accordance with the NYS Property Maintenance Code and/or
the Town of Wappinger Codes, Rules and Regulations; and
WHEREAS, over a period of several years, the Town has issued- numerous orders to
remedy violations to the owners of the Property, Gerald M. Reiser and Nola Dee Reiser, and
commenced actions in the Town of Wappinger Justice Court to prosecute violations of the Town
Code and Zoning Code, however the violations continue to exist, if not worsen; and
WHEREAS, beginning on or about August 11, 2009, Gerald M. Reiser, owner, was
convicted of the following offenses: violation of NYS Property Maintenance Code Section 3021,
and failure to maintain the exterior of the property; on August 10, 2010, violation of Town
Ordinance 302.4 for failure to maintain grass on the property; and on October 10, 2011, violation
of Town Ordinance 302.4 for having high grass and weeds on the property and 307.1 for having
rubbish on the property; and
WHEREAS, the Town of Wappinger Justice Court is without jurisdiction to issue a
mandatory injunction ordering the owners to cure said violations, making it necessary to
commence suit in the Supreme Court of the State of New York, County of Dutchess seeking,
among other things, equitable relief to enjoin the continuing violations.
NOW, THEREFORE, BE IT RESOLVED, as follows:

1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the Attorney to the Town, Albert P. Roberts,
Esq., to commence and prosecute to its conclusion an action against the owners of
the Property, Gerald M. Reiser and Nola Dee Reiser, in Supreme Court Dutchess
County, seeking any and all available remedies the Attorney deems appropriate to
address.
3. The Town Board also hereby authorizes the Attorney to the Town, Albert P.
Roberts, Esq., to coordinate and work with the Dutchess County Department of
Health and the Dutchess County Attorney's office in any actions that the
Department may take with respect to this Property.
4. Supervisor Barbara A. Gutzler is hereby authorized to execute on behalf of the
Town any documents necessary for the commencement of said lawsuit.

RESOLUTION: 2013-137
Introducing "Local Law No. —of the Year 2013 Amending Chapter 201 of the Town of
Wappinger Code Entitled "Smoking and Tobacco Use Prohibited"
WHEREAS, it has been brought to the attention of the Town Board that Chapter 201 of
the Town of Wappinger Code entitled "Smoking and Tobacco Use Prohibited" currently does
not prohibit tobacco smoking and tobacco use in Town owned motor vehicles, trucks and motor
equipment; and
WHEREAS, the Town Board finds that smoking tobacco and tobacco use is detrimental
to the health and safety of the public as well as Town employees and has determined that it is in
the best interest of the public and Town employees to prohibit tobacco smoking and the use of
tobacco in all Town owned motor vehicles, trucks and motor equipment; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR § 617.5 (c) (20) and is
otherwise exempt from environmental review pursuant to the New York State Environmental
Quality Review Act ("SEQRA").
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby introduces for adoption Local Law No. of the Year
2013 in the form annexed hereto.
3. The Town Board determines that the enactment of the aforementioned Local Law
is a Type II action as defined in 6 NYCRR 617.5 and Chapter 117 of the Code of
the Town of Wappinger and, accordingly, the Town Board hereby expressly
determines that this action is not an action that requires review pursuant to the

Local Law No. of the Year 2013 to be held at Town Hall, 20 Middlebush
Road, Wappingers Falls, New York on the 10th day of June 2013, at 7:30 p.m.,
and the Town Clerk is directed to post the Notice of the Public Hearing in the
form annexed hereto and to publish same in the Southern Dutchess News and
Poughkeepsie Journal as required by law.

IX. Items for Special Consideration
X. New Business
Councilwoman Czarniecki
Councilwoman Czarniecki thanked Highway Superintendent Graham Foster for repairs
done on Drew Court and. Helen Drive. She also stated that she had put in a request to acquire
donated computers from Marist College. One computer will be going to the Town of Wappinger
Senior Center, and the other will be going to Grinnell Library. Councilwoman Czarniecki said
she would be picking the computers up later in the week. Supervisor Gutzler thanked
Councilwoman Czarniecki.
Councilman Bettina
Councilman Bettina thanked Chief Van Tassell for his response to a fire at A&W Scrap
Yard. He also thanked all of the other fire companies and the firefighters who responded to the
fire. Councilman Beale stated that there is a major problem with the water supply in that area. He
said that if there is ever a fire in the Chelsea Ridge Apartment Complex it will be a very bad
situation. Councilman Beale explained that it took upwards of twenty minutes to fill tankers with
water because the water system could not create enough water. Also, he passed several black fire
hydrants that water could not be drawn from. Councilman Beale said that it makes him nervous
to think about if the .fire was in the apartment complex. Councilman Bettina stated that there
have been concerns about hydrants that were being fed by ponds at the apartment complex. He
explained that it has been a bone of contention to get water to the Chelsea Ridge apartments.
Councilman Bettina stated that he is happy that there will be water being brought to Chelsea
eventually. He hopes that with the pipes going into that area that water will be brought to
Chelsea Ridge Apartments. Councilman Beale stated that currently the only hydrant that can be
tapped into is from the old system. He said that he would prefer to be proactive about this
situation than reactive after a tragedy occurs. Supervisor Gutzler explained that Fire Inspector,
Mark Lieberman, has been keeping her up to speed on the situation at A&W scrap yard.
Councilman Beale explained the procedure for how the fire departments get water when there are
no hydrants nearby. Supervisor Gutzler commended the fire companies on their work.

Councilman Beale reminded the Town Board and the residents that the Hughsonville Fire
Department's 100th Anniversary festivities were coming up this weekend.

Supervisor Gutzler informed the Town Board that the Town's Payroll clerkk has requested
permission to attend training in Buffalo. Councilman Beale moved a motion allowing the Payroll

Clerk to attend the training session. Councilman Kuzmicz seconded the motion and all Board
Members voted in favor.

Supervisor Gutzler stated that Wheeler Hill Road was being closed to through traffic for
the duration of construction of the water line going through that area. She then described the
training that she had attended at the New York State Finance School in Saratoga. She dispersed a
CD of information and programs provided by the NYS Comptroller's Office. Supervisor Gutzler
recommended that if given the chance, the other Town Board members should attend the school
next year.
Supervisor Gutzler stated that she had a letter dated May 22 from Sheriff Anderson
describing a ceremony and tribute to officers who gave their lives in the line of duty. She also
had an invitation from the Boy Scouts to attend a Flag Day Ceremony. Finally, she received a
letter from the American. Legion and the VFW in the Village of Wappingers Falls announcing
the annual Memorial Day ceremonies. The Board then discussed the many Memorial Day
ceremonies that are taking place in the Town of Wappinger.
Supervisor Gutzler updated the Board on the logging operation that has been taking place
on Fowlerhouse Road. She stated that there are some logs that are still there. The logging
operation was finished in four days, and the trucks were supposed to get things out but people
did not want a high volume of traffic. So the company went in with 1-2 trucks per day.
Supervisor Gutzler spoke to the logging company who told her that the logs are being taken to
Canada.
